The Health and Safety By-law applies to construction and demolition on lands within Administrative Control Area (AC-01) where a permit is required under the Building Code Act, 1992, S.O. 1992, c. 23, as amended. Prior to starting any construction or demolition projects please confirm within our Building Section if your property is within the Area AC-01 by emailing building@belleville.ca.
The Administrative Control Area (AC-01) is located south of the CP Rail tracks, west of South John Street, east of Victoria Harbour and north of Harbour Drive as shown in the map below.
Background on the Area AC-01 |
Various industrial and commercial uses since the early 1900’s such as coal and oil storage facilities, rail line, a former coal gas plant and a scrap metal operation have resulted in impacts to the soil and ground water quality in this area. Further information on the history of the lands can be found on our Former Coal Gas Plant webpage. Environmental investigations have not identified adverse effects on the current land uses in the area due to the presence of the Contaminants of Potential Concern (COPCs) provided that Risk Management Measures (RMM) are in place. |
Purpose of the Health and Safety By-law in the Area AC-01 |
The purpose is to protect the health and safety and well-being of the people and the environment by requiring those who disturb soil during construction or demolition in, on or under lands within the area designated as “AC-01” to implement the established Risk Management Measures (RMMs) for Area AC-01, which were developed in conjunction with the Ministry of Environment, Conservation and Parks. The intention is to ensure that projects that may include excavation or disturbance of soil and/or applicable changes to an enclosed space are completed in a manner that minimizes the potential for adverse effects. |

Building and Demolition Permits within the Area AC-01 |
When applying for a Building or Demolition Permit for a property that is located within the Area AC-01, a completed copy of the AC-01 Attachment to Building Permit form will be required to accompany the application. Compliance with the Health and Safety By-Law is required and is the responsibility of the owner. |
