Protocol for Wireless Communication Facilities

Application for Telecommunication Towers & Antennas  

1. The Director of Engineering & Development Services shall be designated as the City’s contact for purposes of managing this protocol. The protocol applies to telecommunications carriers, businesses, governments, Crown agencies, operators of broadcasting undertakings and the public (including for amateur radio operation and over-the-air TV reception).
2. Prior to finalizing any plans the applicant will consult with the Director of Engineering & Development Services in order to identify any local concerns in the search area, any opportunities to co-utilize existing structures, and to identify land owned by the City which may be a suitable site for a lease.
3. Subject to any engineering or economic limitations, the proponent shall be required to consider sites in the following order:
   • sites co-located on existing structures;
   • land outside of zoned or designated residential areas;
   • land owned by the City; and
   • new structures on land owned by private land owners.
4. The proponent shall agree to provide drawings and information for the City’s review at a site plan level of detail together with a justification report documenting the site selection process and an explanation for the height and built form of the new facility. The applicant will also provide this information to any other agencies identified by the City.
5. Upon agreement between the proponent and the City regarding a proposed facility, the proponent shall provide the City with a legally binding undertaking to construct the facility in accordance with the information package outlined in clause 4 of this protocol.
6. In order to ensure that the affected public is consulted, the proponent agrees to provide a notification package, as required through Industry Canada’s Default Public Consultation Process, to the local public (including nearby residences, community gathering areas, public institutions, schools, etc.), neighbouring land-use authorities, businesses, and property owners located within a radius of three times the tower height. The radius is measured from the outside perimeter of the supporting structure. For the purpose of this requirement, the outside perimeter begins at the furthest point of the supporting mechanism, be it the outermost guy line, building edge, face of the self-supporting tower, etc.
7. Where facilities are proposed to have a height of 30 metres or more, the proponent agrees to publish notice of the proposed facility in a local community newspaper in accordance with Industry Canada requirements.
8. Nothing in this protocol will serve to exempt the proponent from the requirements of Industry Canada.
